Employer of Record explained

What is an EOR in Kuwait?

An Employer of Record in Kuwait is a local legal employer that employs workers under an agreed arrangement for another business. Its responsibilities can include employment contracts, payroll, benefits and HR administration. Where an authorised arrangement is available, it may let you hire without creating your own Kuwait employing entity.

Your company defines the role and business objectives. The confirmed employing organisation manages the employer responsibilities agreed in the service contract. Establish who signs employment documents, pays salaries and handles any required sponsorship or permit processes.

The arrangement must suit the role, worksite and provider's authorisations. Your own commercial activities can also require a separate licensing assessment. Explore our global Employer of Record services for your wider expansion plan.

Kuwait Employer of Record support to discuss with TXM

Confirm the employing organisation and service scope before onboarding. Your hiring plan can cover these workstreams.

Hiring feasibility

Review the sector, occupation, worksite and candidate status. Assess the employing organisation's authorisations and available permit route.

02

Employment contracts

Coordinate local terms covering salary, allowances, hours, leave and contract duration, with the required language and documentation.

03

Work and residency planning

Assess overseas recruitment or local transfer requirements. Plan relevant permit, medical, health insurance, residency and Civil ID steps.

04

Payroll administration

Agree payroll cut-offs, salary funding dates, KWD payments, permitted deductions and wage protection responsibilities.

Send the role, sector, work location, headcount, salary range and candidate nationality or residency status.

2

Assess eligibility

Confirm the legal employer, permitted assignment structure, localisation requirements and immigration dependencies.

3

Approve the scope

4

Check the local requirements

Kuwait employment compliance before your first hire

PAM and employer readiness

Confirm the employing organisation's labour file, permitted activities and ability to obtain the required work approval for the proposed role.

Employment documentation

Align the offer, employment terms, occupation and official records. Establish the required Arabic documentation and employee copies.

Wage protection

Confirm the wage payment and WPS obligations that apply to the legal employer. Agree the process for salary transfers and payment records.

Kuwaitisation

Assess applicable national workforce requirements by employer activity and sector. An EOR arrangement does not automatically remove those obligations.

PIFSS and GCC employees

Check social insurance obligations for covered Kuwaiti and GCC nationals. Contribution treatment should follow the employee's applicable scheme.

Residency and travel

Track expiry dates and renewal responsibilities. Review applicable travel and exit-permit procedures before scheduling overseas business trips.

Confirm feasibility before committing

Permit eligibility depends on the candidate and employing organisation. Nationality, occupation, qualifications, existing residency and the assignment can affect the route.

Review the actual hire before promising a permit, transfer or start date.

Employee entitlements

Overseas recruitment and local transfers

Work permits and Article 18 residency in Kuwait

For an expatriate private-sector hire, assess both work authorisation and the relevant residence process. The candidate's existing residency category determines whether the route involves a local transfer, a new overseas hire or another eligible process.

Prepare a candidate-specific checklist. It may include a passport, qualifications, authenticated police clearance, medical evidence, employment documents and health insurance. Confirm the current requirements before collecting documents.

Build an itemised employment budget

How much does EOR in Kuwait cost?

The total depends on the employee, hiring route and service scope. Compare the full employment budget alongside the monthly administration fee.

  • Salary and agreed allowances in KWD
  • Work permit, residency, transfer and Civil ID charges where applicable
  • Document attestation, medical and health insurance costs
  • Applicable employer social insurance contributions
  • Leave, overtime and end-of-service provisions
  • EOR fees, setup charges and any agreed recruitment support

Ask which charges are recurring, which are one-off and whether deposits or reimbursable expenses apply.

Your Kuwait hiring questions

EOR in Kuwait: frequently asked questions

Can I hire in Kuwait without setting up my own company?

An eligible EOR arrangement may allow a local employing organisation to employ your candidate. Confirm the provider's authorisations, the permitted assignment and your own activity or licensing obligations first.

What does a Kuwait Employer of Record handle?

The agreed scope can cover employment contracts, payroll, benefits, employee administration, permit coordination and offboarding. The service agreement should identify the legal employer and allocate each responsibility.

Can I hire a candidate already living in Kuwait?

A resident candidate can be assessed, but holding a Civil ID does not establish eligibility for the proposed job. Review their current sponsor, residency category and applicable transfer conditions.

What is Article 18 residency?

Article 18 is the private-sector employment residence route. Work approval and residence procedures are related processes; confirm the route and documents for the employee's circumstances.

Can I hire someone on family residency?

Assess the candidate's current residency and any available work permit or conversion route. Do not assume the same process applies to every family-sponsored resident.

Does an EOR remove Kuwaitisation obligations?

No. Applicable national workforce requirements still need assessment for the employing organisation and sector. Include them in the feasibility review.

How quickly can an employee start?

Timing depends on permit eligibility, document readiness, employment terms and government approvals. A local transfer can involve different steps from recruiting someone overseas.

Do all employees have the same social insurance costs?

No. Check the applicable treatment for covered Kuwaiti and GCC employees. Build the quote using the candidate's nationality and insurance scheme rather than one flat contribution rate for all hires.

How is end-of-service indemnity calculated?

Assess the employee's pay category, service, legally relevant wage components and reason for leaving. Applicable caps, resignation rules and statutory exceptions can affect the entitlement. Review unused leave and final wages separately.

What should we check before an employee travels?

Review current exit-permit procedures, residency validity and any work-related travel requirements. Kuwait introduced an exit-permit requirement for expatriate private-sector workers in 2025; confirm the current process for the specific employee.

Is payroll outsourcing the same as EOR?

No. Payroll outsourcing processes pay under an agreed scope. An EOR is the legal employer. If you already have a Kuwait employing entity, payroll-only support may be a separate option.

What should I send TXM to get started?

Share the role, sector, work location, headcount, salary range and target date. Add candidate nationality, current country, residency status and any required qualifications or professional registrations.
